These Website Terms of Use (the "Terms") govern your access to and use of unmade.design (the "Site"). The Site is operated by Unmade Inc., a Delaware corporation ("Unmade," "we," "us," or "our").
By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.
The Site provides general information about Unmade and its services, including Post-Click Growth, strategy, copy, design, development, experimentation, and related ecommerce-growth work.
The Site does not offer products for direct purchase, does not process payments, and does not create a client-services relationship merely because you visit the Site, submit an inquiry, book a call, or receive information from us.
Any services performed by Unmade are governed only by a separate written agreement signed by the applicable Unmade entity and the applicable client. For projects performed by Unmade Design Group, S.A. de C.V., the relevant contracting entity will be identified in the applicable proposal or services agreement. If there is a conflict between these Terms and a signed client-services agreement, the signed client-services agreement controls.
You may use the Site for lawful, personal, and legitimate business-evaluation purposes. You agree not to:
The Site and all content on it, including text, copy, graphics, visual design, logos, trademarks, videos, case studies, frameworks, methodologies, software, and other materials, are owned by or licensed to Unmade and are protected by applicable intellectual-property laws.
You may view and print reasonable portions of the Site for your own internal, non-commercial evaluation of Unmade. No other use is permitted without our prior written consent.
“Unmade,” our logos, and other brand elements on the Site are trademarks or trade dress of Unmade Inc. or its licensors. Nothing in these Terms grants you a license or right to use them.
The Site may allow you to submit an inquiry through Typeform or request a meeting through Calendly. By submitting information, you represent that it is accurate and that you have the right to provide it to us.
Do not submit confidential, proprietary, or highly sensitive information through the Site unless we have agreed in writing to receive it. We may use information you submit to respond to your inquiry, schedule a meeting, assess potential fit, and otherwise operate our business, as described in our Privacy Notice.
Submitting an inquiry or booking a meeting does not create any obligation for Unmade to provide services, accept a project, enter into a business relationship, or keep information confidential unless we expressly agree in writing.
The Site may include case studies, client testimonials, examples, projections, or descriptions of past results. These materials are provided for general informational purposes and illustrate specific circumstances; they do not guarantee that you or any business will achieve the same or similar results.
Ecommerce performance depends on many factors outside Unmade’s control, including traffic quality and volume, product-market fit, pricing, offer, inventory, internal operations, creative, media strategy, technology, timing, and client implementation. Any specific commitment, performance framework, or commercial term will be stated only in a separate written agreement signed by Unmade.
The Site may use or link to third-party services, including Typeform, Calendly, Google Analytics 4, Microsoft Clarity, Meta, and external websites.These third parties operate under their own terms and privacy policies. Unmade does not control and is not responsible for third-party content, services, availability, security, or practices.
Your use of third-party services is at your own risk and subject to the applicable third party’s terms.
Our collection and use of personal information are described in our Privacy Notice. By using the Site or submitting personal information through it, you acknowledge that you have reviewed the Privacy Notice.
The Site is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Unmade disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, security, and freedom from errors or viruses.
We do not warrant that the Site will be uninterrupted, error-free, secure, or available at all times, or that any information on the Site is complete, current, or suitable for your particular needs.
To the fullest extent permitted by applicable law, Unmade and its directors, officers, employees, contractors, affiliates, licensors, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, business, data, goodwill, or anticipated savings, arising out of or related to your use of, or inability to use, the Site.
To the fullest extent permitted by applicable law, Unmade’s total liability for any claim arising out of or relating to the Site or these Terms will not exceed one hundred U.S. dollars (US $100).
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
You agree to defend, indemnify, and hold harmless Unmade and its directors, officers, employees, contractors, affiliates, licensors, and suppliers from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or related to your violation of these Terms, unlawful use of the Site, or infringement of another person’s rights.
We may modify, suspend, discontinue, or update any part of the Site at any time without notice. We may also update these Terms from time to time. The updated Terms will be posted on this page with a revised “Last Updated” date. Your continued use of the Site after updated Terms are posted means you accept the revised Terms.
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law rules. Subject to applicable law, any dispute arising from or related to these Terms or the Site will be brought exclusively in the state or federal courts located in Delaware, United States.
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. A failure by Unmade to enforce any provision of these Terms is not a waiver of that provision or of any other provision.
